TERMS AND CONDITIONS

The terms and conditions set out below cover all work undertaken by Letter Creative, including copywriting, web design, creative concepts, artwork and illustrations. 

 

1. Quotations/proposals
Before commencing work on a client project, Letter Creative will supply a proposal of timescales and costs, based on the outline information provided by the client. All proposals and quotations are provided on Letter Creative's understanding of the project discussed and may increase or decrease dependent on the final scope of the project. Where major changes to scope incur a significant uplift in costs, Letter Creative will inform the client of this before embarking on the work.

2. Commencement of a project
Following the proposal, the client's creative brief and email instruction requesting the start of copy/design/concept/illustration to Letter Creative and subsequent agreement from Letter Creative to begin, then forms the official commencement of the project wherein the client also gives agreement to the quoted fee and timescales outlined in the proposal.

3. Contract
If the client's work is on behalf of any organisation, company or group of individuals other than the client alone, the client confirms that they are authorised to hire Letter Creative on their behalf.

If the client hires Letter Creative on behalf of a marketing agency to work for the agency on a project for a third party, a contract will exist only between Letter Creative and the agency, and not between Letter Creative and the agency’s client.

4. Revisions
Should revisions to work be necessary, Letter Creative is committed to completing them promptly.  If the client wishes to revise any aspect of work, they must specify this in writing, otherwise it will be assumed that the client is satisfied with the final version as delivered. 

 

5. Expenses
If there are any expenses incurred for travel, telephone or post that exceed the normal day to day work, especially overseas, the client will be advised in advance - these will be itemised on the invoice accordingly if charges are needed.

 

6. Errors, Omissions and Indemnity
Letter Creative will make every effort to ensure that work supplied is free of errors and omissions. For printed materials, the client is requested to review the material thoroughly before committing the  project to live production, and responsibility after client sign-off remains with the client.
 

The client shall hold Letter Creative harmless against any liability anywhere in the world, including liability arising from copyright infringement and libel, that results in any way from the clients use of services and counsel on this project.   The client agrees to indemnify Letter Creative against any claim for compensation or damages brought about as a direct or indirect  consequence of the work completed.

It is the sole responsibility of the client to ensure that all statements, claims, promises, information on said product or service, and guarantees are upheld in accordance with the laws of England and Wales. No claim for compensation or disembursement due to loss of earnings or any other detrimental effect to your business can be made against Letter Creative.

 

7. Non-disclosure and confidentiality agreements
Letter Creative commits to sign confidentiality or non-disclosure agreements as deemed necessary, however by way of this agreement the client agrees to indemnify Letter Creative against any action whatsoever by themselves or a third party.

 

8. Copyright
The copyright and ownership of creative concepts, copy and illustrations developed by Letter Creative shall be fully transferred to the client upon full payment of the applicable invoice. However the client commits to not using these for libellous, malicious or illegal purposes.

 

9. Showcasing your project
Where possible, Letter Creative may use the finished project for portfolio display. Letter Creative reserves the right to use selected extracts of the work for self-promotion or advertising purposes unless specifically forbidden to do so by a confidentiality or non-disclosure agreement.

Where this includes materials written by someone else, Letter Creative will make every effort to ensure that copyright is not breached. However, the client confirms that they are authorised to send the material for use either as reference material or to form part of a new piece of work, and the client indemnifies Letter Creative against any action arising, directly or indirectly, as a result of use of this content.
